Social Playbook, LLC (“Social Playbook,” “we,” “us,” and/or “our”) respects your privacy and values its relationship with you. In this privacy policy (this “Privacy Policy”) we describe the types of information we collect from and about you through the Social Playbook website or application (the “Social Playbook app”), whether accessed via computer, mobile device, or other technology (collectively, the “Services”). We also describe how that information may be used, with whom it may be shared, and how you can reach us to get answers to questions you may have about our privacy practices. Finally, we also set forth certain legal rights you may have, subject to applicable law, and how you can exercise them. This Privacy Policy does not cover the practices of companies we do not own or control or people we do not manage.
By using the Services you acknowledge the practices described in this Privacy Policy. In addition, please review our Terms of Service (available at https://socialplaybook.app/terms-of-service), which governs your use of the Services and any content you submit to the Services.
When you use the Services, you are interacting with an artificial intelligence (“AI”) conversational bot provided by Delphi AI, a third-party company. Your interactions, responses and requests either via written or spoken form are stored by Delphi AI. Please refer to https://www.delphi.ai/privacy-policy for more information.
1. INFORMATION COLLECTED ON OUR SERVICES
We may collect the following categories of information when you use our Services:
Information You Provide to Us Directly:
· Contact information, such as first name, last name, email address, phone number, and physical address (including another person’s information when you send them a gift card or similar function).
· Sign-in information, such as username and password, account name, and account number.
· Demographic and profile information, such as profile photo, age, location, and interests. We will not access your photos or the camera on your computer, tablet, mobile phone, or other device (“Device”) without first getting your explicit permission. If you give us permission to access photos or your Device’s camera, we will only use images or videos that you specifically choose to share with us.
· Audio, video, and voice recordings, and text.
· Payment Information, such as card number, expiration date, security code, and billing address, where needed to complete a transaction. Please note that Delphi AI processes all payments and stores your payment information. Refer to https://www.delphi.ai/privacy-policy.
· Correspondence you send us.
Some of the information that we collect may be considered sensitive under applicable laws. We only process such information in order to provide the Services and within other exemptions under applicable law.
Information We Collect Automatically: We may collect information automatically, such as your device type, Internet Protocol (“IP”) address, device and advertising identifiers, browser type, operating system, Internet service provider, the date and time of your visit, and information about the links you click and your activity on our Services. We also may collect information about the number of frequency of visitors to our Services and how they interact with the Services. Our business partners may collect general location information inferred from your IP address, which is used for app functionality and service provision purposes such as verifying your time zone.
We may aggregate or de-identify the information described above, in which case we will not attempt to re-identify such information. Aggregated or de-identified data is not subject to this Privacy Policy. We may also disclose aggregate statistics regarding user behavior as a measure of interest in, and use of, our Services and emails to third parties in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user.
Information We Collect from Other Sources:
We may obtain and combine personal information from other sources, such as:
· Payment Processors, who receive and process your payment information to facilitate any financial transactions. Social Playbook does not collect or store that information. However, we may receive limited information about your payment card such as the last four digits of your card, the country of issuance, and the expiration date only for the purposes of fulfilling the order.
· Another Social Playbook User, such as to provide you a gift.
· Third-Party App Stores, such as to inform us of a purchase or cancellation.
2. HOW WE USE THE INFORMATION COLLECTED
We use the collected information described above to provide services you request, including:
· To provide you with the information, products, and services that you request, including processing your purchases, identifying you when you sign into your account, and responding to your questions;
· To develop and improve our Services;
· To notify you about changes to our Services, promotional materials, and other communications from us;
· To monitor use of our Services, and detect, prevent, and address technical issues and engage in data analytics and troubleshooting;
· To keep our Services, business and users safe and secure;
· To comply with applicable laws and regulations;
· To protect or exercise our legal rights or defend against legal claims; and
· For any other purpose with your consent.
3. HOW WE SHARE PERSONAL INFORMATION
We may share information about you in the following circumstances:
· Companies under Common Control. We may share information between and among any current or future parents, subsidiaries, affiliates, and other companies under common control and ownership with Social Playbook.
· Business Partners. We may share your personal information with our business partners that perform functions on our behalf, such as companies or individuals that host or operate our Services, analyze data, provide customer service, or respond to your inquiries. For example, we use Delphi AI to provide the AI technology. Delphi AI collects your email address and payment information and may use a third-party payment processor to process payments. Delphi AI has access to chat/audio transcripts. Please refer to Delphi AI’s privacy policy https://www.delphi.ai/privacy-policy. In addition, if you choose to connect the Services to third-party platforms , we may supply certain information, such as the amount of time you spend using the Services to the third-party platform. Before you tell us to share your information with another platform, we encourage you to review the applicable privacy policy and terms of use for that platform as any information you instruct us to share will become subject to those policies. We are not responsible for safeguarding any information stored within those platforms.
· Business Transfers. In the event that Social Playbook, or substantially all of its assets, are acquired by one or more third parties as a result of any merger, acquisition, financing, re-organization, bankruptcy, sale, or transition of services to another provider, personal information may be one of the transferred assets.
· Legal Purposes. We may disclose information, including your personal information and other device identifiers (including IP address), to government authorities, and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law in our good faith belief, including but not limited to in response to court orders and subpoenas and as otherwise required in connection with a judicial or government proceeding or legal process. We also may disclose such information when we have reason to believe that someone is causing injury to or interference with our rights or property, other users of the Services, or anyone else that could be harmed by such activities. Social Playbook cooperates with law enforcement inquiries and other third parties to enforce laws, intellectual property rights, and other rights.
· Other Purposes with your Consent.
Social Playbook does not, and will not without consent, sell your information to third parties. Social Playbook may permit business partners to collect the information described above through our Services and may disclose such information with business partners for business purposes as described in this Privacy Policy. The information practices of these third parties are not covered by this Privacy Policy.
4. ADVERTISING, COOKIES, AND SIMILAR TECHNOLOGIES
When you use our Services, we and our third-party advertising partners may use cookies, pixel tags, local storage, and other similar technologies (collectively, “cookies”) to collect information from your browser or device. By using our Services, you consent to our use of cookies and similar technologies.
Some web browsers have a “Do Not Track” preference that transmits a “Do Not Track” header to the websites you visit with information indicating that you do not want your activity to be tracked. We currently do not respond to browser “Do Not Track” signals, as there is no standard for how online services should respond to such signals. As standards develop, we may develop policies for responding to do-not-track signals that we will describe in this Privacy Policy.
5. YOUR RIGHTS AND CHOICES
You may be entitled, in accordance with applicable law, to object to or request restriction of processing of your information, and to request access to, rectification, erasure, and portability of your information or more information about our information practices. You may submit a request to exercise the following rights by contacting us using one of the methods in the “How to Contact Us” section below. Once we receive a request, we may verify it by requesting information sufficient to confirm your identity.
You may have certain rights and choices, such as:
· Accessing, Correcting, or Deleting Your Information. Depending on where you live, you may have the right to access, correct, or delete personal information you have provided. Depending on the jurisdiction, you and/or your parent or legal guardian may exercise these rights by contacting us using one of the methods in the “How to Contact Us” section below. Please note that if you choose to close your account, we may keep certain personal information as necessary to comply with our legal obligations or for legitimate business purposes, such as to resolve disputes or enforce our agreements. We may also keep cached archived copies of personal information for a certain period of time. If you delete your account or the app from your device, all personal information you have recorded that is stored locally will be lost.
· Portability of Your Information. You can request a copy of your personal information in an easily accessible format along with information explaining how that data is used.
· Right to Restrict Processing. In certain cases where we process your information, you may also have the right to restrict or limit the ways in which we use your personal information.
· Opting Out of Email Marketing. You can opt out of receiving our promotional emails at any time by following the instructions included in those emails. Please be aware that it may take up to 10 days for us to process your request, and you may continue receiving promotional communications from us during that period. If you opt out of receiving such communications, please be aware that we may continue to send you non-promotional emails (such as emails related to our business relationship or emails about changes to our legal terms).
· Limiting Information in Your Profile. You can control the information we collect about you by limiting the information you provide through your profile or content you provide in user recordings.
· Disabling Push Notifications. With your consent, we may share push notifications or alerts to your mobile device or send you emails. We use push notifications to inform you of important updates and to send you reminders. You can manage or deactivate these notifications at any time by disabling notifications through the device settings on your mobile device. If you choose not to receive push notification, you will still receive in-app notifications in the “Notifications” section of the app.
· Limiting Device Permissions. With your consent, we may access your mobile device’s camera, microphone, or storage features. However, we will never import any photos or audio files other than those you explicitly choose to share. At any time, you can turn off these features using the device settings of your mobile device. However, many of the features included in the Services do require the use of your device’s microphone.
· Right to Withdraw Consent. Where we rely on consent, you can withdraw your consent to our processing by using various means we offer, such as an email unsubscribe link or your account settings. This is without prejudice to your right to permanently close your account and delete your personal information.
We will consider all requests and provide our response within the time period stated by applicable law. Please note, however, that certain information may be exempt from such requests in some circumstances, which may include if we need to keep processing your information for our legitimate interests or to comply with a legal obligation. Before responding to your request, we may require that you provide us with additional information to confirm your identity.
You may be entitled, in accordance with applicable law, to submit a request through an authorized agent or to appeal a refusal to take action on your request. To designate an authorized agent to exercise your rights and choices on your behalf, please provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government-issued identification. We may verify the authenticity of the request directly with you. You also may be entitled, in accordance with applicable law, to appeal a refusal to take action on your request; to do so, please contact us using one of the methods in the “How to Contact Us” section below. You also have the right to lodge a complaint with a supervisory authority if you believe our processing of your information is unlawful.
Limiting use of or deleting your personal information may affect features and uses that rely on that information. We will not discriminate against you for exercising any of your rights, including otherwise denying you goods or services, providing you with a different level or quality of services, or charging you different prices or rates for services, except as otherwise permissible under law.
State Law Privacy Rights.
California Resident Rights
Shine the Light. California Civil Code § 1798.83, also known as the “Shine The Light” law, permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. In order to submit such a request, please contact us using one of the methods in the “How to Contact Us” section below. Social Playbook does not share personal information with third parties for their direct marketing purposes.
Nevada Resident Rights
If you are a resident of Nevada, you have the right to opt out of the sale of certain personal information to third parties who intend to license or sell that personal information. You can exercise this right by contacting us contact us using one of the methods in the “How to Contact Us” section below with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account.
6. LINKS TO OTHER SITES
We may provide links to third-party websites, services, and applications that we do not own or operate. This Privacy Policy does not apply to the privacy practices of those third parties. The fact that we link to a website, service, or application is not an endorsement, authorization, or representation of our affiliation with that third party. We encourage you to review the privacy policies of any third-party service before providing any personal information to or through them.
7. HOW WE PROTECT PERSONAL INFORMATION
Protecting your information is a priority for us and we maintain commercially reasonable measures to protect the security and integrity of all information collected via the Services to help protect against loss, misuse or unauthorized access, disclosure, alteration, or destruction of your personal information. However, you should understand that due to the inherent nature of the internet as an open global communications vehicle, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use the Services and provide us with your information at your own risk. Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.
8. HOW LONG WE KEEP YOUR PERSONAL INFORMATION
We only keep your personal information for so long as reasonably necessary for the purposes described in this Privacy Policy, as required by law, or as necessary to resolve disputes and enforce our rights and agreements.
9. INTERNATIONAL USERS
The Services are designed for and targeted to U.S. audiences and are governed by and operated in accordance with the laws of the U.S. We make no representation that our Services are operated in accordance with the laws or regulations of any other nations. By using the Services, or providing us with any information, you consent to the collection, processing, maintenance, and transfer of such information in and to the United States, and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy.
10. CHILDREN UNDER 13
Our Services are directed at those 13 and older and we do not knowingly collect or solicit personal information from people under the age of 13. If you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any personal information. If we learn we have collected personal information from a child under 13 years of age, we will delete that information as quickly as possible. If you are a parent or legal guardian and think your child under 13 (or a higher age threshold where applicable) has given us personal information without your consent, please contact us at [email protected].
11. UPDATES TO OUR PRIVACY POLICY
We may modify this Privacy Policy from time to time. If we make changes to this policy, we will post the updated Privacy Policy on our website and revise the “Last updated” to when it was last revised. We recommend that you review this Privacy Policy each time you visit the Services to stay informed of our privacy practices.
